The plaintiff, Eugene Stockwell, eighteen years of age, was enrolled as a student at Stanford University in the freshman class, and while on the university campus sustained personal injuries resulting in the loss of his right eye. Alleging that his injuries were proximately caused by the negligence of the university in failing to use reasonable care in maintaining its premises in a safe condition, he brought this action to recover damages for the loss of his eye. The cause came on for trial before a jury, but when plaintiff rested his case the trial court granted a nonsuit. From the judgment of dismissal entered thereon plaintiff appeals.
