1. Courts รข€” Rules of court, effect of. Rules of court when properly promulgated have force and effect of law within territorial limits of district affected thereby and such rules are binding not only on parties and their attorneys, but also on court and its officers. 2. Courts รข€” Disregard of rule. General disregard to particular rule of court by consent, acquiescence or waiver will not excuse such disregard in particular case when adverse party insists on his rights. 3. Courts รข€” Judge without authority to hear motion to suppress. Where rule promulgated by Supreme Court pursuant to its authority to apportion business between judges in district court upon failure of judges to make such apportionment apportioned business by requiring that civil and criminal proceedings with even numbers should be assigned to department No. 2 of court and that odd numbered cases should be assigned to department No. 1 and that judge of department to which case was originally assigned might re-assign cause to another department when convenient, judge of department No. 2, in absence of assignment of case by judge of other department, had no authority to hear motion to suppress evidence in odd numbered case and proceedings thereon were void.
